HOUSTON — A 7-year-old boy who was allegedly shot in the head by a couple who thought he and three other people were trespassing on their property died Saturday, authorities said.

Donald Coffey Jr. died Saturday morning at a Houston hospital, less than two days after the boy was struck in the head by shotgun pellets, Liberty County Sheriff's Cpl. Hugh Bishop said.

Sheila Muhs and her husband, Gayle Muhs, both 45, were charged with second-degree felony counts of aggravated assault in the shootings Thursday. They were being held at Liberty County Jail with bail set at $25,000 each and had not yet retained an attorney, Bishop said.

Bishop said the district attorney could upgrade the charges to murder on Monday, but investigators were "still trying to get the circumstances behind the incident."

The boy, his 5-year-old sister, their father and a family friend were off-roading near a residential area about 40 miles northeast of Houston when they were shot after stopping so the children could go to the bathroom.

Authorities said the couple fired after they mistakenly thought the group was trespassing on their property.

Bishop said the area includes a dirt road, trees and overgrown brush and that it wasn't uncommon for people to go off-roading there. The Houston Chronicle reported that a sign in front of the suspects' home reads: "Trespassers will be shot. Survivers will be reshot!! Smile I will."

Liberty County Chief Deputy Ken DeFoor said Sheila Muhs fired a 12-gauge shotgun once, then handed it to her husband, who also fired once.

DeFoor said Sheila Muhs then called 911 and told the dispatcher: "They're out here tearing up the levee, so I shot them."

DeFoor said the levee belonged to the subdivision and was not private property.

Bishop said there was no indication the unarmed victims did anything threatening toward the Muhs.

Donald Coffey Sr. suffered a pellet wound in his right shoulder and his daughter, Destiny, suffered a wound to the elbow. The family friend, 30-year-old Patrick Cammack, was in serious condition Saturday with a head wound, Memorial Hermann-Texas Medical Center spokeswoman Alex Rodriguez said.

Thats why we have gun laws in Canada so the insane cant have them. In my world they both get the DEATH PENALTY by stoning.

This is terrible. We used to go to a place in Oklahoma to ride our 4 wheelers. When we talk about it we called it NO MANS LAND land. You could ride all day long in the mountains and never see anyone. There were several cabins up in there but they were all used for hunting and you could only get there on 4 wheelers or something like that. There was no electricity or water up there. But, you don't ride to far on the North side of the cabin. Because, there are people over there that would shot you then ask questions later. A friend of our was out riding around and wondered off over in that direction(that was easily done) with his two sons and said that there was people hiding in the woods and they came out shooting. No one was hit but they said they would never go on that side again. I would believe that anyone that lived like that with a gun in hand would have something to hide.
It would not surprise me when the cops does there investigation that they find drugs or a drug lab that this couple was involved in.
Remember it was not the gun that killed the boy it was the person that pulled the trigger.

Sad. R.I.P. Little guy!!!

Mr Big block, not to argue with you but any insane person can obtain a riffle of a gun in Canada, it's called the black market. 99.9% of criminal use registered stolen weapons to comit there crimes. The only people controled by gun registry are honest hard working people. Criminals already don't care about the law and will obtain guns and riffles regardless.

Lets not fight about gun laws..... we here in the U.S.A have our freedoms and tend to fight hard about it..... as I am sure Our friends to the north do too.

If someone trespasses on my property I call the Police. If they come in the house while I am home well....... that is another story........

I would be intrested in finding our what the investigation turned up.

All the corses I took made it cear you don't shoot if you can't identify your target.

Same here...I mean simply trespassing is not a reason to gun down someone...by no means. A verbal warning, some nice signs about being brought to justice, stuff like that. But you see...Here in Canada, if someone comes into my house, while I'm there with my kids, I can not defend myself for I will be charged with assult. If I chose to use deadly force on an intruder, I better have a damn good lawyer and even at that....I'm probably going to jail!

Fight for your rights to bare arm and deffend yourselves, here...We gave up that right to the Governemnt that is supposed to know better and protect us from the bad guys....LOL!

Peace out.

My thoughts on gun control...

Guns don't kill people...People kill people. It all comes down to being responsible for your actions...and the consequences of those actions.
